The Dutch data protection authority, the Autoriteit Persoonsgegevens (AP), has taken action against Microsoft, accusing the tech giant of violating data protection laws with its Windows 10 operating system. According to the watchdog, Microsoft was found to be collecting user data without clearly informing users about what specific information is being sent to its servers and for what purpose. The AP emphasized that when users install Windows 10 with default settings, the system continues to gather detailed usage data, including information about applications and web browsing activities.
Furthermore, the organization pointed out that Microsoft automatically enables full telemetry settings by default, which means users are not given a real choice but to accept these privacy-invading defaults. During the installation process, the Windows 10 setup also includes options for sharing telemetry data and displaying personalized ads and recommendations in both Windows and Edge. The DPA stressed that simply not changing these settings does not imply user consent for the collection and use of personal data.
In addition, the Dutch authority criticized Microsoft for failing to respect user privacy settings during updates. Specifically, systems that were initially configured with basic telemetry settings were automatically upgraded to full telemetry without any user input or confirmation. This practice, according to the AP, allows Microsoft to track user behavior extensively, giving the company deep insights into how Windows 10 users interact with their devices.
This latest move by the Dutch DPA highlights growing concerns over how major tech companies handle user data, especially when it comes to transparency and user control. As more countries tighten their data protection regulations, companies like Microsoft face increasing pressure to ensure that user privacy is respected at every step of the software experience.
