Urban lighting management regulations

The "Regulations on Urban Lighting Management" has been reviewed and approved at the 55th executive meeting of the Ministry of Commerce and is hereby promulgated and will be implemented as of July 1, 2010.

Chapter I General Provisions

Article 1 These regulations are formulated in order to strengthen urban lighting management, promote energy conservation, and improve urban lighting environment.

Article 2 These regulations apply to the planning, construction, maintenance and supervision of urban lighting.

Article 3 Urban lighting work shall follow the principles of people-oriented, economical, energy-saving and environmental protection, beautifying the environment, and strictly control the energy consumption of decorative landscape lighting for public facilities and large buildings.

Article 4 The competent department of housing and urban and rural construction under the State Council shall guide the urban lighting work throughout the country.

The competent departments of housing and urban and rural construction of the people's governments of the provinces and autonomous regions shall supervise and manage the urban lighting within their respective administrative regions.

The city lighting department determined by the city people's government is responsible for the specific work of urban lighting management within its administrative area.

Article 5 The competent department of urban lighting shall commend or reward units and individuals that have made outstanding achievements in urban lighting energy conservation work.

Chapter II Planning and Construction

Article 6 The competent department of urban lighting shall, in conjunction with relevant departments, organize the preparation of special plans for urban lighting in accordance with the overall urban planning, and report to the people's government at the same level for organization and implementation.

Article 7 The competent department of urban lighting shall entrust a unit with corresponding qualifications to undertake the preparation of the special plan for urban lighting.

The preparation of urban lighting special plans shall, in accordance with the level of urban economic and social development, combined with the urban natural geographical environment and humanities conditions, and the urban functional divisions determined according to the overall urban planning, and put forward requirements for lighting effects in different areas.

Article 8 Units engaged in urban lighting engineering survey, design, construction and supervision shall have corresponding qualifications; relevant professional and technical personnel shall obtain corresponding qualifications for practicing according to law.

Article 9 The competent department of urban lighting shall, in accordance with the special plan for urban lighting, organize the formulation of an annual plan for the construction of urban lighting facilities, and report it to the people's government at the same level for approval.

Article 10 Newly built or rebuilt urban lighting facilities shall determine the brightness and energy consumption standards of various types of regional lighting according to the special plan for urban lighting, and comply with relevant national standards.

Article 11 The construction funds for urban lighting facilities invested by the government shall be included in the urban construction fund plan.

The state encourages social funds to be used for the construction and maintenance of urban lighting facilities.

Article 12 The functional lighting installation rate of new or rebuilt urban road projects shall reach 100%.

Urban lighting facilities that are compatible with urban roads, residential areas and important buildings (structures) shall be designed, constructed, accepted and used in accordance with urban lighting planning and construction.

Article 13 The building (structure) and supports that meet the installation conditions of urban lighting facilities may be installed with lighting facilities without affecting their functions and surrounding environment.
